Things you should know about working as a Sr. Manager, Liability Claims & Litigation:

 

The primary purpose of this role is to direct and manage liability claims brought by third parties arising from vehicular accidents, products, vending equipment, and various actions of employees on third party property. This position will direct and manage claims brought by partners, customers’ accounts, and freight consigners. In performance of such direction, this position manages all legal defense functions to include development of case strategy, filings, discovery and settlement evaluation. This position will be involved in the management of potential property, cyber, subrogation, aviation, and environmental claims, each with respective deductible/self-insured retention coverage programs. Will assist the Director of Claims & Litigation with claim forecasting, actuarial analysis, SOX compliance, and excess carrier coverage utilization and coordination.

 

What would success look like?

 

  • Management of claims staff consisting of dedicated claim adjuster team. Monitor that various key performance indicators are being obtained. Leading claim file reviews; Work with various business units to collect information and be available for 24/7 response
  • Direction of individual file reserving and settlement conference attendance
  • Direction and oversight for statue required settlement set-asides and/or structured settlements
  • Direct selection of defense counsel within litigation guidelines. "In person" participation (as CCCI representative) in settlement meetings with plaintiff and defense attorneys, mediators, attendance at select depositions and trials in state and federal courts in all states in which CCCI conducts business
  • Direction and handling of subrogation and loss recovery programs working with third party fleet department
  • Management and assistance to the Director of Claims and Litigation with Crisis/Incident Management and Emergency Planning, property claims or site emergencies, aviation, cargo, product tampering and product defect, environmental concerns and engineered product claims
  • Demonstrate Servant Leadership - accountability, consistency, timeliness, supportiveness, commitment to teamwork

 

QUALIFICATIONS:

 

  • Must have extensive multi-line claim experience, no less than seven (7) years in a senior level claims role with settlement authority of no less than $500,000
  • This position must have extensive knowledge of liability claims administration to include litigation avoidance and early intervention programs
  • This position must have a thorough understanding of complex medical treatments, treatment outcome indications, tort, venue, and jurisdictional matters, as wells as highly developed investigative and analytical skills which support merit-based case evaluation
  • This position must have a demonstrated history of strong legal case management
  • Experience in evaluating cases in both State and Federal courts is critical
  • To be successful, this individual must be able collaborate with cross functional teams
  • Strong proficiency with certain PC applications (Microsoft Excel, PowerPoint, RMIS systems)

 

Preferred

 

  • Four – year degree
  • Driver’s License
  • Risk Management Certifications a plus (i.e. Associate in Claims (AIC) or Associate in Risk Management (ARM))
